Ellsworth spoke with Mary Kate Fernandez of Adams and Reese, who provided valuable insights into the H-1B Visa program and how it can be a game-changer for large construction companies, particularly those looking to fill specialized roles like project managers and engineers.
The H-1B Visa is an employer-sponsored visa that allows foreign nationals with a bachelor's degree or equivalent experience to work in the United States for up to six years. The process, however, is highly competitive, with a government-mandated cap of 85,000 visas issued each year. This makes the program particularly attractive to companies that require highly skilled workers, often in roles that cannot be easily filled domestically.
Mary highlighted the importance of understanding the nuances of the H-1B Visa program, particularly its suitability for specialized positions within construction. "Definitely project manager positions and anything that's going to require an engineer," Mary explained. "It's larger companies that have multi-level management, and then people that are going to have a degree that fits into the requirements of that role."
For construction firms, particularly those involved in complex projects or research-driven manufacturing, the H-1B Visa can be a critical tool for attracting top international talent. However, navigating the application process can be daunting, and Mary expressed the need for careful planning and legal expertise. "If you’ve identified a candidate that has a degree, you're most likely going to be fine moving forward with that petition," she advised, representing the importance of early recruitment efforts, especially at the university level.
